Sheriff: Two Branchport residents arrested for scamming and stealing from elderly victim

Pair of thieves rack up 31 felony charges for bilking 75 year old while hospitalized

PENN YAN, NY — The Yates County Sheriff’s Office announces the arrest of two individuals on an arrest warrant stemming from an ongoing investigation into the financial exploitation of an elderly Penn Yan-area resident.

On October 16, 2026, David Flansburg, age 44, of County House Rd, Branchport, NY, was arrested pursuant to an arrest warrant on the following charges:

Grand Larceny in the Third Degree (NY Penal Law § 155.35), a Class D felony 1 count

Conspiracy in the Fourth Degree (NY Penal Law § 105.10), a Class E felony 6 counts

Criminal Possession of a Forged Instrument in the 1st Degree (NY Penal Law § 170.30), a Class C felony 6 counts

Angela Vasquez, age 31, also County House Rd, Branchport, NY, was arrested pursuant to the same warrant on the following charges:

Grand Larceny in the Third Degree (NY Penal Law § 155.35), a Class D felony 2 counts

Conspiracy in the Fourth Degree (NY Penal Law § 105.10), a Class E felony 6 counts

Criminal Possession of a Forged Instrument in the 1st Degree (NY Penal Law § 170.25), a Class C felony 9 counts

Petit Larceny (NY Penal Law § 155.25), a Class A misdemeanor 1 count

The charges stem from Complaint #2026-09708, which was initiated on August 22, 2026, after a family member reported that funds had been taken from the financial accounts of a 75-year-old relative without his knowledge or authorization. The victim, who had been hospitalized for an extended period during the relevant timeframe, told investigators he did not write or sign several checks drawn on his accounts at two local financial institutions.

The investigation revealed that checks bearing the victim’s purported signature were cashed at local financial institutions and that the proceeds were used, in part, by the defendants for personal purchases.

Both defendants are scheduled to appear in CAP court.

The Yates County Sheriff’s Office reminds residents that charges are accusations, and all defendants are presumed innocent until proven guilty in a court of law.
