A Geneva man is facing felony charges after Penn Yan police concluded an investigation into an alleged sexual assault reported earlier this fall.
According to the Penn Yan Police Department, 37-year-old Bryan Garcia-Perez was arrested in connection with an incident that reportedly occurred on October 24 within the village. Investigators allege that Garcia-Perez sexually abused a woman who was intoxicated or unconscious during two separate encounters in Yates County.
Police said Garcia-Perez has been charged with two counts of Sexual Abuse in the First Degree, each classified as a Class D felony under New York State law.
Garcia-Perez was arraigned in Yates County CAP Court, where he was released on pre-trial conditions. He is expected to appear in Penn Yan Village Court at a later date as the case proceeds.
