A Geneva man already facing serious child sex abuse charges at the state level has now been charged federally following a joint investigation involving local police and the FBI.
U.S. Attorney Michael DiGiacomo announced Thursday that 27-year-old Rafael Arroyo-Ubiles has been charged by criminal complaint with production and possession of child pornography. Federal officials said the charges carry potential penalties of up to 30 years in prison, lifetime supervised release, and fines reaching $250,000.
According to prosecutors, Arroyo-Ubiles first came to the attention of the Geneva Police Department during a January narcotics investigation into alleged illegal drug sales in the City of Geneva. Authorities executed multiple search warrants during the investigation. While reviewing an online account allegedly connected to Arroyo-Ubiles for evidence tied to narcotics activity, investigators reportedly discovered videos depicting the sexual abuse of a 5-year-old girl.
Federal officials said Arroyo-Ubiles appeared before U.S. Magistrate Judge Colleen D. Holland and was ordered held pending further court proceedings. The federal case is being prosecuted by Assistant U.S. Attorney Kyle P. Rossi.
The federal charges come one week after Arroyo-Ubiles was arrested by Geneva City Police on April 30. In that case, investigators charged him with first-degree rape, first-degree sexual abuse, and use of a child in a sexual performance following the execution of search warrants at residences in Geneva and Seneca Falls.
The investigation involved the Geneva Police Department, under the direction of Chief Ronald Eveland, along with the Federal Bureau of Investigation. Authorities emphasized that the charges are accusations and the defendant is presumed innocent unless and until proven guilty in court.
