The jury trial of Penn Yan lawyer Thomas Plan ends with not guilty verdict

Plan, a dual British and German Citizen, voluntarily surrendered to the Yates County Sheriff in August 2025

The Yates County Sheriff’s Department reported on August 15, 2025:

“A 30 year old man with dual European citizenship committed a violent crime in Yates County NY in 2024. Today a Grand Jury issued a warrant for Thomas Plan’s arrest and Plan surrendered himself to authorities.”

Plan was accused of a two felony counts, was arrested, plead not guilty, and posted $10,000 bail.

Because of conflicts regarding Mr. Plan’s work as a lawyer in Yates County, special prosecutor Steuben County District Attorney Brooks Baker was appointed to the case. Baker told the Keuka Sun that the

“The case was tried in Yates County Court, at the close of the People’s proof the Defendant moved to dismiss the case and that application was denied.  The Court found there was sufficient proof to send the case to the Jury under a beyond a reasonable doubt standard of proof.  The jury found there was not sufficient evidence to prove him guilty beyond a reasonable doubt – so they did their duty and rendered a not guilty verdict.”

Plan was pleased with the outcome and issued this statement to the Sun:

 “I am grateful for the jury, the jury system, my family and friends, and everyone else who came to trial to see where the truth is.”
